Aerolenz Services Agreement
1. Services and Scope
Aerolenz agrees to provide professional photography, videography, and drone services as outlined in the applicable project quote or agreement. Any additional services requested outside the original scope may incur additional fees and require approval.
2. Payment Terms
- Deposit: A non-refundable deposit is required to secure the booking date.
- Final Payment: The remaining balance is due on or before the date of the shoot, unless otherwise agreed to in writing during the quoting process.
3. Cancellation and Rescheduling
- Client Cancellation: Cancellations made within 48 hours of the scheduled shoot will result in forfeiture of the deposit. Cancellations made more than 48 hours in advance may be rescheduled once, subject to availability.
- Weather Policy: Due to the nature of drone and camera operations, Aerolenz reserves the right to reschedule shoots in the event of unsafe weather conditions (including high winds, rain, or other hazards) at no additional cost to the Client.
- Safety: The Photographer/Videographer retains full authority over safety decisions. If any shot is deemed unsafe or non-compliant with FAA regulations, Aerolenz reserves the right to refuse that portion of the shoot.
4. Intellectual Property and Licensing
- Copyright: Aerolenz retains full copyright ownership of all original images and video footage captured.
- Usage License: Upon full payment, the Client is granted a non-exclusive license to use the delivered media for business and personal purposes, including marketing, websites, social media, and print use.
- Restrictions: The Client may not sell, transfer, or distribute raw footage to third parties without prior written consent from Aerolenz.
5. Creative Control and Delivery
- Editing Style: Aerolenz will perform standard post-processing and editing. Creative control over the final look and style remains with Aerolenz. Client input is welcomed during the initial briefing.
- Delivery Timeline: Final media will be delivered via a Google Drive shared album within the agreed-upon number of business days following the shoot.
6. Liability and Indemnification
- Equipment: Aerolenz is not liable for delays caused by equipment failure or unforeseen technical issues beyond its control.
- Permits: The Client is responsible for obtaining any required permissions or permits for shooting locations unless otherwise agreed in writing.
- Indemnification: The Client agrees to indemnify and hold harmless Aerolenz from any claims, damages, or legal fees arising from the Client’s use of the delivered media.
